1. Acceptance of Terms
By accessing or using the RiseWithin mobile application ("App") and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
2. Description of Service
RiseWithin is a mobile application designed to help users practice daily affirmations for personal growth and mental wellness. The App provides:
- Curated affirmation content across multiple categories
- Personalized affirmation recommendations
- Audio playback with background music options
- Progress tracking and reminder features
- Premium subscription features for enhanced functionality
3. User Accounts
You may use RiseWithin as a guest. Creating a sign-in account is optional, including after purchase. Your guest data is associated with an app-generated identity; reinstalling the app or losing device credentials may make that data inaccessible. Restoring an Apple subscription restores eligible access, but does not by itself recover private data under a lost guest identity. If you create an account, you are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
You must provide accurate information when creating your account and keep it updated.
4. Subscription and Payments
RiseWithin provides an unpaid onboarding preview of two complete affirmations. My Voice requires submitting guided recordings; you may instead choose the standard narrator. Full app use requires an active subscription, eligible trial or admin-granted access. Monthly and annual plans are offered at the localized prices shown before purchase. An eligible seven-day introductory trial is available on the annual plan only; the monthly plan has no trial. For subscriptions:
- Payment will be charged to your Apple ID or Google Play account at confirmation of purchase
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- You can manage and cancel subscriptions in your device's account settings
- Refunds are handled according to Apple App Store or Google Play Store policies
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the App's functionality
- Copy, modify, or distribute App content without permission
- Use automated systems to access the App
6. Intellectual Property
All content in the App, including text, graphics, logos, audio, and software, is the property of RiseWithin or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express permission.
7. Health Disclaimer
RiseWithin is designed for general wellness and personal development purposes only. The App is not intended to:
- Diagnose, treat, cure, or prevent any medical or mental health condition
- Replace professional medical or psychological advice
- Serve as a substitute for therapy or counseling
If you are experiencing mental health issues, please consult a qualified healthcare professional.
8. Limitation of Liability
To the maximum extent permitted by law, RiseWithin shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the App. Our total liability shall not exceed the amount you paid for the App in the twelve months preceding the claim.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or completely secure.
10. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified Terms.
11. Termination
We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the App will immediately cease.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RiseWithin operates, without regard to conflict of law principles.
